VT Open Meeting Law Changes – July 1, 2024
Vermont towns have a great number of committees and boards, which have different requirements for public participation and for recordkeeping. As of July 1, 2024, the Open Meeting Law was amended to include new requirements. The new requirements are segmented into two categories: Advisory and Non-Advisory.
Boards or committees acting in an Advisory capacity (i.e. Conservation Commission, Traffic Safety Task Force, Auditors) are held to a looser standard than non-advisory boards or committees. These boards may hold fully remote meetings and are not required to record their meetings.
Boards that have supervision, control, or jurisdiction over legislative, quasi-judicial, tax or budgetary matters are considered Non-Advisory. The Selectboard, Library Board, Trustees of Public Monies, Trustees of the various Copeland Funds, Board of Civil Authority and Board of Tax Abatement are always non-advisory boards. The Listers are considered non-advisory when setting the Grand List and holding Grievance Hearings. As such, these boards must provide an in-person meeting location, record meetings, post their recordings on the town’s website, and, if requested, provide access to meetings by phone or virtually.
If you believe that a meeting was improperly held, you can use the MTS OML Complaint Form to notify the Selectboard of your concerns.
